NYC Office Waste and Recycling: What Your Cleaner Does and What You Are Still Liable For

Your cleaning crew executes the sorting. The liability stays with you and your building. Under 16 RCNY §1-10, commercial businesses must source-separate paper, cardboard, metal, glass, plastic and beverage cartons, label every container by material type, and post signage in both collection and storage areas. Fines run $50 to $400 per violation.

Commercial Waste Zones: Check Your Date

Under Local Law 199 of 2019 the city is divided into twenty commercial waste zones, each served by three authorised carters plus five citywide carters for loading-dock and compactor containers. Businesses that fail to sign with an authorised carter within their sign-up window are assigned a carter at the maximum allowable rate.

The Licence Question to Ask Your Vendor

Off-site commercial waste hauling requires a Business Integrity Commission trade waste licence. Most janitorial companies do not hold one and do not need to — they stage waste to the building's compactor or dock, which is entirely legal. Ask directly: do you hold a BIC trade waste licence, or does your scope end at the compactor? Either answer is fine. Vagueness is not.

Commercial Organics Thresholds

Under Local Law 146 of 2013, covered generators include food service establishments at or above 7,000 sq ft (or 8,000 sq ft combined, and chains with two or more NYC locations totalling 8,000+); hotels with 100+ rooms; retail food stores at or above 10,000 sq ft; food preparation establishments at or above 6,000 sq ft; caterers at events with 100+ attendees; public events with 500+; arenas with 15,000+ seats; food manufacturers at or above 25,000 sq ft; and wholesalers at or above 20,000 sq ft. A typical standalone office falls below these — a building with a ground-floor restaurant or a real cafeteria may not.
