What Is the Programme?

Under Local Law 199 of 2019, New York City is divided into twenty commercial waste zones. Each zone is served by three authorised carters, plus five citywide carters licensed to handle loading-dock and compactor containers. The intent is to reduce truck traffic and improve safety and service standards by ending the situation where dozens of haulers serve the same block.

For a business, the practical effect is simple: you can no longer sign with any hauler you like. You choose from the carters authorised for your zone.

What Happens if We Do Nothing?

You get assigned a carter, at the maximum allowable rate set by the Business Integrity Commission. That is the entire penalty structure and it is a sufficient one — the maximum rate is meaningfully above what you can negotiate yourself.

Does My Cleaning Company Handle This?

Partly, and it is worth being precise about which part. Your cleaning crew physically executes source separation — they put the paper in the paper stream and the bottles in the recycling stream, and they move it to the compactor or dock. That is real work and it matters.

What they do not do is take it off site. Off-site commercial hauling requires a Business Integrity Commission trade waste licence, and most janitorial companies do not hold one. That is entirely normal. What is not acceptable is vagueness. Ask directly: do you hold a BIC trade waste licence, or does your scope end at the compactor?

Who Gets the Fine if We Get It Wrong?

The business and the building — not the cleaning company. Under 16 RCNY §1-10, commercial businesses must source-separate paper, cardboard, metal, glass, plastic and beverage cartons, label every container by material type, and post signage in both collection and storage areas. Fines run into the hundreds of dollars per violation, and a hauler collecting designated recyclables as trash faces a far larger penalty.

What Should We Actually Do This Month?

  1. Find your zone and your implementation date. If you are in Midtown South, confirm which carter now collects from you and whether you chose them or were assigned one.
  2. If your sign-up window is open, review the authorised carters for your zone and sign with one. Do not wait for assignment.
  3. Check who signed up with the carter — in a multi-tenant building it is often the building, not you. Ask your managing agent.
  4. Audit your own containers: is every bin labelled by material type, and is the required signage posted in both the collection area and the storage area?
  5. Ask your cleaning vendor to report contamination when they see it at source. It is free and it is the earliest warning you will get.
